By using this Website, you expressly accept all terms and conditions contained herein in full. You must not use this Website if you have any objection to any of these Website Standard Terms And Conditions. It is advisable to check this page regularly to take notice of any changes we may have made to the Terms of Service.

1.Conditions of Contract

By placing an order through our Site, you warrant that you are legally capable of entering into binding contracts and are at least 18 years old. After placing an order, you will receive an email acknowledging that we have received your order. This does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. If there is any reason we cannot accept or fulfill your whole order, we will contact you.

2.Intellectual Property Rights

The website is owned and operated by EasyCarParts Limited, and all contents and designs are protected by copyright. Browsers using the site are permitted limited rights to view and print the contents for personal use only.

3.Restrictions

You are expressly and emphatically restricted from the following:

- Publishing any Website material in any media.
- Selling, sublicensing, and/or otherwise commercializing any Website material.
- Using this Website in any way that may be damaging to this Website.
- Using this Website in any way that impacts user access.
- Using this Website contrary to applicable laws and regulations.

- Using this Website for advertising or marketing.
- Disclosing confidential user ID and password information.

4.Conditions of Delivery and Payments

For any information regarding the costs for packaging and posting as well as the payment conditions, please refer to the conditions of delivery and payments on the respective Internet portal. For deliveries abroad, we reserve the right to possibly limit the payment options.

5.Guarantees

5.1. The Consumer is entitled to submit to the Seller the claim for non-conformity of the goods within two years from the date of purchase of the goods. The Consumer fills the non-conformity application to the Seller within two months from the day when the goods are found to be defective. The date of purchase of the goods shall be deemed to be the day on which the Seller transmitted, and the Consumer has accepted the goods in question.

5.2. If the Manufacturer or Seller has given a warranty to the product, after the expiry of the period two years, the Consumer is entitled to submit the claim throughout the remainder of the warranty period in accordance with the conditions specified in the warranty document. The Consumer claim is examined in accordance with the conditions specified in the warranty document.

5.3. When applying for a defect of the product to the Manufacturer or Seller, the Consumer shall attach a copy of the document certifying the transaction to the claim application.

5.4. The Consumer’s claim will be reviewed within 7 business days from the date of receipt of the claim, and the response will be sent to the contact address specified in the claim. If the claim is found to be unfounded, and the Buyer disagrees with it, he/she is entitled to exercise other rights specified in regulatory enactments.

6.Payment Policy

6.1. Accepted Payment Methods: EasyCarParts.ie accepts payments via credit/debit cards (including VISA, MasterCard, PayPal) and bank transfers.

6.2. Credit/Debit Card Payments:
   a. Upon selecting credit/debit card as the payment method, customers are required to click "buy" to proceed.
   b. Customers will be securely redirected to a payment page where they can select their card type.
   c. Correct card information must be entered, and payment must be confirmed.
   d. The customer's card will only be charged after the order has been completed.

6.3. Bank Transfers:
   a. For customers opting to pay via bank transfer, the order will not be dispatched until payment has been received in cleared funds.
   b. Customers are responsible for ensuring that the correct payment reference is provided when initiating the bank transfer.
   c. Orders paid via bank transfer will be processed upon confirmation of receipt of payment.

6.4. Payment Security:
   a. EasyCarParts.ie prioritizes the security of all payment transactions.
   b. All credit/debit card transactions are conducted through a secure and encrypted payment gateway to protect customers' financial information.
   c. Customers are advised to ensure that they are using a secure and trusted internet connection when making payments.

6.5. Payment Currency:
   a. All transactions on EasyCarParts.ie are processed in Euro (EUR), unless otherwise specified.
   b. Customers making payments with non-Euro currency cards may be subject to currency conversion fees by their card issuer.

6.6. Payment Confirmation:
   a. Upon successful completion of the payment process, customers will receive an order confirmation email.
   b. This confirmation serves as acknowledgment that the payment has been received and the order has been placed.

6.7. Payment Disputes:
   a. In the event of any payment disputes or discrepancies, customers are encouraged to contact EasyCarParts.ie's customer support promptly for resolution.
   b. EasyCarParts.ie reserves the right to withhold order processing or delivery until payment disputes are resolved satisfactorily.

6.8. Changes to Payment Policy:
   a. EasyCarParts.ie reserves the right to update or modify the payment policy at any time.
   b. Customers will be notified of any changes to the payment policy via email or by posting the updated terms on the website.

7.Delivery Terms and Conditions for EasyCarParts.ie:

7.1 Delivery Timeframe:
   - Orders are generally delivered within 5-10 working days after receipt of payment.
   - Order processing begins the day after payment is received, adding 1 working day to the delivery service.
   - For orders placed on non-working days (Saturday or Sunday), No delivery on bank holidays, please allow an additional 1 working day for delivery.

7.2. Delivery Costs:
   - Orders below €100,00 will incur a delivery cost of €20,00.
   - Free shipping is provided for orders exceeding €100,00 (excluding delivery abroad and special parcels such as oversized, exchange items, tyres, and etc).

7.3. Parcel Weight Limitations:
   - Each standard box has a weight capacity based on its size.
   - Packages exceeding this limit or not fitting into a standard box are classified as oversize.
   - Heavy packages may be dispatched in multiple boxes or specialized packaging.
   - These measures aim to ensure safe delivery and prevent damage during transit.

7.4. Extra Charges for Oversized Cargo:
   - Certain spare parts are considered oversized cargo and may incur additional charges.
   - Oversized items include, For Example: Racing exhaust pipes, Manifold, Battery, Catalyst, Muffler, Threshold, Wing, Spoiler, Fuel tank, Trailer coupling (hitch), Front cowling,                        Engine compartment lid, Engine compartment insulation, bumper and etc.

7.5. Delivery Restrictions:
   - Orders are currently restricted to shipping within the Republic of Ireland only.
   - Soon, we will expand our shipping services to include other European countries.

7.6. Bulk Orders:

- If the order includes the same product in a quantity of 5 or more, please note the following:

- Such orders may be subject to additional review and approval.

- EasyCarParts.ie reserves the right to limit or reject orders that are deemed to be intended for resale.

- Bulk orders may have extended processing and shipping times.

- Special shipping rates may apply, which will be communicated during the order confirmation process.

 

8.Cancellation

When you purchase online, you have a statutory right to return a Product up to 14 days after your order has been delivered. We can change or cancel an order up until it is dispatched. If the order has been dispatched, you have to return the Product to us, and we will organize a refund (excluding delivery cost).

9.Returns

9.1. General Returns:
   - Customers can return items if they change their mind or are dissatisfied with the purchase. However, the item must be in resalable condition, and the original packaging must be included. Returns are accepted within 14 days after the customer receives the parcel. Items must be in their original condition, unused, and with all original packaging intact.

9.2. Faulty or Incorrect Items:
   - If a customer receives a faulty or incorrect item from EasyCarParts Limited, they should notify the company as soon as possible by contacting us at info@easycarparts.ie. EasyCarParts will attempt to replace the item promptly.

9.3. Return Procedure:
   - Customers should send an email to info@easycarparts.ie within 14 days of delivery. The email should include the customer's name, address, order number, and details of the returning products. Customers should await further instructions on how to proceed.

9.4. Cancellation Deadline:
   - To meet the cancellation deadline, customers must send a notice regarding the exercise of the right to cancel before the cancellation deadline expires.

9.5. Refund Process:

Please note that any refund shall be made using the same method originally used by you to pay for your purchase. Additionally, prior to providing a refund, we may first verify the details with the manufacturer and conduct an investigation if necessary.

9.6. Refund Method:
   - Any refund shall be made using the same method originally used by you to pay for your purchase. Refunds will be provided after investigation by the manufacturer to ensure the validity of the claim.

9.7. Return Conditions:
   - Any Products returned shall be subject to the following conditions:
     - You have contacted our customer service by email or telephone.
     - You have re-placed the Products in the package in which they were delivered to you.
     - The package is wrapped and safely secured.
     - You have contacted our customer service and asked for the package to be collected by us.
     - The package, together with a delivery notice (as supplied by us), has been remitted to the delivery company appointed by us.

9.8. Returning Products for which a Deposit has been Paid:
   - Some Products require a manufacturer deposit. The Customer will be informed of this when they place their Order. The amount of the deposit is invoiced by the Company in addition to the price of the Product in question. 
   - However, the Customer may get the said deposit refunded by returning the original part (that is going to be replaced by the Product concerned) to the Company.
   - Please note: the Customer must return the original part in the newly ordered part's original packaging within thirty (30) days after receiving their Order. After this period, the deposit money cannot be refunded. The shipping costs related to the return of Products for which a deposit has been paid are the sole responsibility of the Customer. The original part that is being returned must not be damaged, broken, or heavily corroded.

9.9. Adhesive Safety Tape:

   - All packaging containing parts will be covered with adhesive safety tape. If the safety tape is damaged or broken, it indicates that the part has been used or the original packaging has been opened.
   - In such cases, the product is considered unreturnable, and the customer will not be eligible for a refund or return. Therefore, please handle all packaging with care to maintain the integrity of the safety tape, if you would like to return.

 

10.Limitation of Liability:

10.1 When placing an order, it is your responsibility to ensure accurate order information regarding delivery location, product quantity, and quality. We bear no liability for losses incurred due to failure to comply with this requirement.

10.2 We do not guarantee the suitability or fitness for a particular vehicle of any Products. It is your responsibility to verify suitability before use. We are not liable for losses resulting from the use of Products with non-compatible vehicles, even if vehicle details were provided in the order.

We are not responsible for incorrect installation of the part.

10.3 We are not liable for certain types of losses, including loss of income, business, profits, anticipated savings, data, or management/office time, resulting from our failure to comply with these terms and conditions. However, this limitation does not apply to claims for foreseeable loss or damage to physical property, or claims for direct loss not explicitly excluded.
 

11. WRITTEN COMMUNICATIONS

As required by applicable law, certain information or communications we send to you must be in writing. By using EasyCarParts.ie, you agree that our communications with you will primarily be electronic. We will reach out to you via email or provide information by posting notices on our website. For the sake of contractual agreements, you consent to this electronic method of communication and acknowledge that all contracts, notices, information, and other communications provided to you electronically satisfy any legal requirement for written communication. This condition does not affect your statutory rights.

 

12. FORCE MAJEURE

12.1 EasyCarParts shall not be held liable for any failure to perform, or delay in performance of, any of its obligations under this agreement that is caused by events outside its reasonable control (Force Majeure Event).

12.2 A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond EasyCarParts' reasonable control, including but not limited to:

- Strikes, lock-outs, or other industrial actions affecting the automotive industry.
- Civil commotion, riot, invasion, terrorist attack, or threat of terrorist attack, war (whether declared or not), or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster affecting manufacturing or distribution.
- Impossibility of the use of railways, shipping, aircraft, motor transport, or other means of transportation crucial for the supply chain.
- Impossibility of the use of public or private telecommunications networks necessary for communication and operations.
- Acts, decrees, legislation, regulations, or restrictions of any government affecting automotive trade and operations.
- Pandemic or epidemic affecting workforce availability or disrupting supply chains related to automotive parts and components.

12.3 EasyCarParts' performance under this agreement shall be deemed suspended for the period that the Force Majeure Event continues, and EasyCarParts shall have an extension of time for performance for the duration of that period. EasyCarParts will use its reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which its obligations under this agreement may be performed despite the Force Majeure Event.

12.4 If the Force Majeure Event continues for more than [30 working days], EasyCarParts shall have the right to cancel the order without liability to the customer.

13. OUR RIGHT TO VARY THESE TERMS

13.1 EasyCarParts reserves the right to revise and amend these terms and conditions periodically to reflect changes in market conditions affecting our automotive parts business, advancements in technology relevant to the automotive industry, alterations in payment methods, changes in relevant laws and regulatory requirements within the automotive sector, and enhancements in our system's capabilities.

13.2 Customers will be subject to the policies and terms and conditions in force at the time they place orders for car parts from EasyCarParts, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by customers), or if EasyCarParts notifies customers of the change to those policies or these terms and conditions before sending the Order Confirmation. In such cases, EasyCarParts reserves the right to assume that customers have accepted the change to the terms and conditions, unless customers notify EasyCarParts to the contrary within seven working days of receiving the products.

14. LAW AND JURISDICTION

14.1 Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Irish law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of Ireland.
